CLEARWATER — A Pinellas County woman is suing St. Petersburg, alleging negligence in failing to maintain its sidewalks.
Melinda Day filed a complaint Oct. 5 in Pinellas County Circuit Court against the city of St. Petersburg, alleging failure to keep the sidewalks in a reasonably safe condition.
According to the complaint, on Oct. 15, 2016, Day was walking on the sidewalk at First Avenue and Sixth Street, St. Petersburg. The suit says Day tripped and fell on a raised portion of the sidewalk that had been permitted by the city to remain in a defective and/or dangerous condition. As a result, Day says, she sustained injuries of a physical and mental nature, incurred a loss of wages and earning capacity and had to pay for medical expenses.
The plaintiff alleges the city of St. Petersburg failed to inspect or adequately inspect the sidewalk to determine whether it was in a defective and/or dangerous condition and failed to warn or adequately warn individuals of the danger of the raised portion of the sidewalk.
Day seeks trial by jury, judgment in excess of $15,000, with interest, court costs and attorney fees. She is represented by attorney Marshall Schaap of Morgan & Morgan Tampa PA in St. Petersburg.
