ORLANDO — An Orlando property landlord is suing a tenant, alleging it owes nearly $18,000 for breach of a lease contract.
AE Development LTD filed a complaint Oct. 4 in Orange County Circuit Court against Brothers Stone Inc. and Walter Muzoz, also known as Walter R. Muzoz and Walter Rene Muzoz, alleging the defendants ceased paying rent and other payments required in the lease agreement.
According to the complaint, on Dec. 31, 2017, the parties entered into a written lease agreement and personal guaranty for the lease of commercial property 7204 Chancery Lane, Orlando, owned by AE Development with Brothers Stone as tenant. The plaintiff says the defendant would lease the property for a two-year period and it agreed to make monthly lease payments.
However, during the lease period, the suit says, Brothers Stone and Munoz ceased making rent and other payments required from July 2017 through August 2017. The suit says the defendants damaged the premises, and then abandoned, deserted and vacated the leased property it had damaged.
The plaintiff alleges the defendants failed and refused to pay the sums due and owing under the lease agreement despite demands and breached the contract by not taking proper care of the leased premises by causing waster, damages and injury to the leased property.
AE Development seeks trial by jury, damages of at least $17,710.18 with prejudgment interest, interest, attorney' fees, court costs and all other just and proper relief. They are represented by attorney Joseph Dayton Foley Jr. of Altamonte Springs.
