Pinellas County couple alleges Publix's negligence led to wife's injuries

CLEARWATER — A Pinellas County couple is suing Publix, alleging negligence led to the wife sustaining injuries.

Rita Nascarella and Salvatore Nascarella filed a complaint Oct. 5 in Pinellas County Circuit Court against Publix Super Markets Inc., alleging failure to provide a safe environment for its business invitees.

According to the complaint, on Sept. 8, 2017, the Nascarellas were at Publix store No. 866 in Clearwater, when Rita Nascarella suddenly slipped and fell in some liquid that was negligently left in the frozen food aisle. As a result of the incident, the suit says, Rita Nascarella suffered serious and permanent injuries to her head, neck, body, back and limbs, and aggravated a pre-existing condition.

The lawsuit states her husband will continue to suffer the loss of companionship, consortium and the services of his wife. 

The plaintiffs allege Publix Super Markets failed to adequately warn Rita Nascarella of the dangerous condition that existed on its premises, failed to adequately maintain the area where the slip occurred, failed to adequately inspect and maintain the hazardous area, and failed to post warning cones or signs in place to prevent injury to customers.

The Nascarellas seek trial by jury damages of more than $15,000, costs of action and prejudgment interest on liquidated damages. They are represented by attorney Tony Griffith of Tanney, Griffith & Bresler PA in Clearwater.
