Orlando property owner alleges insurance company failed to cover water damage

ORLANDO — An Orlando property owner is suing a licensed insurer, alleging breach of an insurance contract.

Lebert Charles filed a complaint Oct. 4 in Orange County Circuit Court against Universal Property and Casualty Insurance Company, the defenant failed to establish that it had reasonable proof that it was not responsible for payment of plaintiff’s losses.

According to the complaint, on April 5, Charles' insured property at 6913 Thousand Oaks Road, Orlando, was damaged indirectly by water due to a slab leak while the insurance policy issued by the defendant was in full force and effect. 

The suit says Charles timely gave notice of such loss to Universal Property but failed to receive a payment. The plaintiff alleges Universal Property and Casualty Insurance failed to pay the requested amounts for repairs and/or replacement pursuant to the terms of the policy of insurance.

Charles seeks trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
