Customer alleges motorcycle store's negligence caused ear injury

ORLANDO — An Orange County man is suing an Orlando motorcycle dealer, alleging negligence led to an ear injury for the plaintiff.

Brian Boscarino filed a complaint Oct. 4 in Orange County Circuit Court against Cycle Gear Inc. and John Doe, alleging they breached their duty to exercise reasonable care for his safety.

According to the complaint, on March 4, 2017, Boscarino was at Cycle Gear on East Colonial Driver in Orlando. The suit says Boscarino injured his ear after trying on a motorcycle helmet without the protective inlay. 

Boscarino alleges he has sustained pain and suffering, mental anguish, medical expenses and loss of earning capability. The plaintiff alleges Cycle Gear's employee negligently removed the helmet's protective padding/lining and then asked Boscarino to try it on.

Boscarino seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Chad S. Lucas of Morgan & Morgan PA in Orlando.
