Apopka property owners allege insurance company failed to cover hurricane damage

ORLANDO — Two Apokpa property owners are suing a liability insurer, alleging breach of an insurance contract.

Son Tran and Thu Thi Nguyen filed a complaint Oct. 4 in Orange County Circuit Court against Florida Specialty Insurance Company, alleging failure to adjust the loss of properly promptly and accurately.

According to the complaint, on Sept. 10, 2017, the Tran and Nguyen's property insured by Florida Specialty at 1050 Oakpoint Circle, Apopka, was damaged by Hurricane Irma’s high winds. 

The plaintiffs say they promptly reported the loss and made a claim to Florida Specialty but failed to receive a payment. The plaintiffs allege Florida Specialty Insurance has refused to properly investigate the claim and wrongfully denied proper coverage and payment for the loss.

Tran and Nguyen seek trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. They are represented by attorney Jeremy R. Griner of Plant City.
