Largo property owner seeks to receive insurance coverage after hurricane

CLEARWATER — A Largo property owner is suing an insurance company, alleging breach of contract.

Earl Blackwelder filed a complaint Oct. 5 in Pinellas County Circuit Court against United Property & Casualty Insurance Company, alleging failure to pay requested amounts for repairs and/or replacement pursuant to the terms of the policy.

According to the complaint, on Sept. 10, 2017, Blackwelder's property at 12859 115th St. N, Largo, was damaged directly and/or indirectly by Hurricane Irma. The suit says Blackwelder gave timely notice to United Property of the loss with a full and particular account of the expenses and losses as a result of the storm. 

However, Blackwelder alleges that despite complying with all conditions, he has failed to receive insurance coverage necessary to repair his damaged property. 

The plaintiff alleges United Property & Casualty Insurance failed to establish that it had reasonable proof that it was not responsible for the payment of Blackwelder's damages and/or loss, and has failed to pay the requested amounts pursuant to the terms of the policy.

Blackwelder seeks trial by jury, damages in excess of $15,000, plus interest, attorney fees, court costs and all other just and proper relief. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
