Seafood supplier alleges restaurant owes more than $17,000

CLEARWATER — A seafood supplier is suing a restaurant, alleging breach of contract.

Sammy's Seafood, Inc. filed a complaint Oct. 9 in Pinellas County Circuit Court against Hurricane Lounge Inc., doing business as Hurricane Seafood Restaurant, and Rick Falkenstein, alleging the defendants breached the terms and agreement of the credit application by failing to pay the balance owed in the contract.

According to the complaint, between June 14-Aug. 20, 2018, Sammy's Seafood sold goods to the defendants and created invoices totaling $19,705,28. Despite demands for payment, the suit says, Sammy's did not receive full payment, leaving a balance due and owing of $17,508.48. 

The plaintiff alleges Hurricane Seafood Restaurant and Falkenstein failed to pay the balance owed under the credit application and terms agreement with an interest rate of 18 percent, including reasonable attorney fees.

Sammy's Seafood seeks trial by jury, judgment of $17,508.48, plus interest, costs of suit, attorney fees and all other just and proper damages. It is represented by attorney Creighton Shafer of Anderson & Shafer in St. Petersburg.
