Roofing company alleges Pinellas County couple owes more than $15,000

CLEARWATER — A roofing company is suing a Pinellas County couple, alleging breach of contract and unjust enrichment.

Done Rite Roofing Inc. filed a complaint Oct. 4, in Pinellas County Circuit Court against Michael J. Kelly and Joan S. Kelly, alleging the defendants breached the contract agreement by failing to pay more than $15,000 under terms of the agreement.

According to the complaint, on March 23, Done Rite Roofing entered into a written contract with the Kellys to remove an old roof and install new roof at the defendants' Pinellas County property. 

Pursuant to the contract, the suit says, Done Rite provided labor, services, and materials that were incorporated into the property, but an amount of $15,389.80 remains unpaid for services rendered. 

The plaintiff alleges the Kellys breached the contract by failing and refusing to pay the $15,389.80, plus interest, that it owes for work pursuant to the contract.

Done Rite Roofing seeks trial by jury, damages of more than $15,000, costs and interest, and any other just and proper relief. It is represented by attorneys Benjamin Hillard, Amy E. Cuykendall and Alexander R. Allred of Hillard, Cuykendall & Allred, PA in Largo.
