Sanford property owner alleges school construction violated Florida Building Code

ORLANDO — A Sanford property owner is suing a construction company, alleging breach of contract and design defect.

Cameron Avenue Charter Property LLC filed a complaint Oct. 4 in Orange County Circuit Court against Summit Construction Management Group LLC, alleging the defendant failed to comply with the the Florida Building Code while constructing the school project.

According to the complaint, on Jan. 25, 2016, Cameron Avenue Charter Property and Summit Construction entered into a construction contract pursuant to which Summit agreed to serve as the design-build contractor for the design and construction of a school. 

Cameron Avenue alleges it complied with the requirements of the Florida Statute Chapter 558 but says the the school was not constructed as required by the Florida Building Code due the numerous defects. 

As a result, Cameron Avenue says it has suffered costs to repair or replace the defective work and investigative costs. 

The plaintiff alleges Summit Construction Management Group failed to perform its work on the school project in the accordance with the terms of the agreement, resulting in the defects on the property and refused to indemnify the plaintiff for all damages as a result of defective work on the project.

Cameron Avenue Charter Property seeks trial by jury, damages in excess of $15,000, plus interest, costs, and all other just and proper relief. It is represented by attorneys James O. Birr, III and Adam B. Edgecombe of Jimerson & Cobb PA in Jacksonville.
