Loan borrower accused of breaching contract by defaulting

CLEARWATER — A bank is suing an individual citing alleged breach of contract.

Ally Bank filed a complaint on Oct. 2 in the 6th Judicial Circuit of Florida-Pinellas County against Brandon J. Peters alleging that the defendant defaulted on the obligation to make payments due under the contract.

According to the complaint, as the predecessor-in-interest of a retail installment sale contract, plaintiff Ally Bank performed all conditions precedent in order to secure payment that the defendant allegedly did not pay for the entire balance due under the contract, $20,680.19, despite demands. 

The plaintiff holds Brandon J. Peters responsible because the defendant allegedly refused to pay balance due and defaulted under the contract despite plaintiff's notices together with accrued and unpaid interest.

The plaintiff requests a trial by jury and seeks judgment for the balance due of $20,680.91, all costs of court and such other and further relief to which plaintiff may be justly entitled. They are represented by Jorge L. Palma of Andreu, Palma, Lavin & Solis, PLLC in Miami.
