Financing company alleges couple owes nearly $6,600

CLEARWATER — A finance company is suing a couple, alleging they owe nearly $6,600 for breach of contract.

Autovest Financial Services LLC filed a complaint Oct. 2 in Pinellas County Circuit Court against Julie Whitman and Joseph Whitman, alleging the defendants defaulted on the obligation to make payments due under a contract.

According to the complaint, as the predecessor-in-interest of a retail installment sale contract, Autovest Financial performed all conditions precedent in order to secure payment that the Whitmans did not do so despite numerous demands. 

The plaintiff alleges the Whitmans refused to pay the balance due and defaulted under the contract despite Autovest's notices, together with accrued and unpaid interest.

Autovest Financial Services seeks trial by jury, judgment of $6,587 for the deficiency balance, plus contractual interest, post-judgment interest, attorney fees, costs of court, and all other just relief. They are represented by attorney Jorge L. Palma of Andreu, Palma, Lavin & Solis PLLC in Miami.
