Clearwater homeowner alleges insurance company refuses to provide coverage

CLEARWATER — A Clearwater property owner is suing an insurance company, alleging breach of contract.

Trevor Blackwelder filed a complaint Oct. 1 in Pinellas County Circuit Court against Citizens Property Insurance Corporation, alleging the defendant refused to provide insurance coverage after a hurricane..

According to the complaint, on Sept. 10, 2017, Blackwelder's property at 1105 Pineview Ave., Clearwater was damaged directly and/or indirectly by hurricane Irma. The suit says the property that was covered under the insurance policy with the defendant. 

Blackwater alleges he complied with all conditions precedent but Citizens Property did not provide insurance coverage despite Blackwater forwarding timely notice of claim. 

The plaintiff alleges Citizens Property Insurance failed to establish that it had reasonable proof that it was not responsible for the payment of Blackwater's damages and/or loss, and has failed to pay the requested amounts for repairs and/or replacement.

Blackwater seeks trial by jury, damages in excess of $15,000, plus interest, attorney fees, costs and all other just and proper relief. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
