Coral Springs homeowner alleges insurer failed to cover hurricane damage

FORT LAUDERDALE — A Coral Springs homeowner is suing an insurer, alleging breach of an insurance contract.

Carmel Etienne filed a complaint Oct. 3 in Broward County Circuit Court against Tower Hill Prime Insurance Company, alleging failure to cover damages caused by a hurricane. 

According to the complaint, on Sept. 10, 2017, Etienne suffered damages as a result of wind and water to her property at 10285 NW 7th St., Coral Springs due to Hurricane Irma. The suit says a hurricane is a covered peril under the insurance policy issued by Tower Hill. 

However, the lawsuit alleges, the defendant has refused to pay the full amount of the insurance proceeds, despite having agreed to provide coverage. 

The plaintiff alleges Tower Hill Prime Insurance obligated Etienne to retain and pay for the services of legal counsel to represent her interests, and has refused to pay the full amount of Etienne's insurance claim.

Etienne seeks trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. She is represented by attorney Roger A. Alvarez of Miami.
