Orlando property owner seeks insurance proceeds after wind damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Jean Direus filed a complaint Sept. 27 in Orange County Circuit Court against USAA Casualty Insurance Company, alleging denial of coverage.

According to the complaint, on Jan. 22, 2017, while the policy was in full force and effect, Direus' property at 16944 Corner Bay Court, Orlando, sustained a covered loss as a result of a wind, wind-driven rain, and/or hail.  

Dierus says he reported the loss to USAA Casualty and the insurance company assigned a claim number and inspected property. However, the suit says, Direus was denied coverage despite paying all premiums due and owing. 

The plaintiff alleges USAA Casualty Insurance has failed to adequately indemnify Direus for the loss and failed to tender an appropriate amount to repair the property.

Dierus seeks trial by jury, damages of more than $15,000, plus interest, court costs and reasonable attorney fees. The plaintiff is represented by attorneys Louis A. Gonzalez and Zaf G. Goss of Vargas Gonzalez Hevia Baldwin LLP in Winter Park.
