CLEARWATER — A resident is suing St. Petersburg independent living facility operators, alleging negligence in failing to respond to her fall.
Adelaide W. Smith filed a complaint Sept. 28 in Pinellas Circuit Court against ARHC ALSPGFLOI TRS, LLC doing business as Addington Place at College Harbor LLC, et al, alleging failure to ensure that she received adequate and appropriate oversight and attention.
According to the complaint, between Jan. 31-Oct. 2, 2016, Smith, who was 93 at the time, was a resident of the defendants independent living facility in St. Petersburg. On Sept. 28, 2016, the suit says, Smith fell while in her apartment and was unable to get up on her own.
The suit alleges even though Smith did not show up for meals for three straight days, no one entered her apartment to check on her condition. Smith says was severely dehydrated and had a fractured hip, acute kidney failure, dysphagia, stage 4 sacral decubitus ulcers and was soiled.
The plaintiff alleges the defendants failed to protect her from reasonably preventable injury and harm and failed to provide a fully operable and monitored mealtime attendance check-in system.
Smith seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Christopher K. Welch of Charlie Tucker PA in Ocala.
