BRYANT & HIGBY: Truck accidents on the rise -- should the government step in?

Pil

Bryant & Higby issued the following announcement on Oct. 1.

Because of the larger size and heavy weight of many semitrailers, Florida readers know accidents involving trucks and smaller vehicles often result in grave consequences. The number of accidents involving large trucks is increasing nationwide, and there are many people who believe the government should take measures to fight this troubling trend. Many hope the government will mandate the installation of crash avoidance technology.

There is technology available that would alert truckers in certain situations, allowing them to avoid crashes. Despite the widespread call for this to be a requirement in the trucking industry, the National Highway Traffic Safety Administration has declined to make this a priority. It is possible failing to do this has led to accidents that were otherwise preventable.

Is technology the answer?

Human error will play a role in many truck accidents. Distraction, speeding, lack of experience and various other factors can contribute to these types of crashes. However, crash avoidance technology could alert truckers to potential hazards and possibly help prevent crashes, specifically rear-end crashes. Consider the following facts about the growing concern over truck accidents, consequences of this trend and possible solutions:

  • The National Transportation Safety Board has been asking the NHTSA to require semis to have crash avoidance technology for years.
  • The NHTSA states it is currently researching the implementation of this technology, but that it will not conclude its investigation for more than a year from now.
  • There is a lot of skepticism from the trucking industry regarding the effectiveness of this technology and the cost of having crash avoidance systems installed.
There are people who believe that the NHTSA, a government agency, is at least partially accountable for failing to act and mandating measures that could save the lives of innocent motorists. If you are the victim of a truck accident, you may find it beneficial to explore the legal options available to you, which could include possibly filing a civil claim.

Holding appropriate parties accountable

It is frustrating to learn that there could be technology available that could have prevented your accident. However, you could still have grounds for legal recourse. Whether you lost a loved one in a truck accident or you suffered injuries yourself, you could have a valid claim to financial compensation.

It is beneficial to start with a complete evaluation of your case. By working with an experienced personal injury attorney, you can understand the options available to you and make choices that are prudent for your physical and financial recovery.
