Couple alleges Winter Park subdivision failed to maintain a safe premises

ORLANDO — Two property owners are suing a Winter Park subdivision, alleging negligence led to injuries.

Scott Gifford and Julie Gifford filed a complaint Sept. 20 in Orange County Circuit Court against Country Lakes Community Association Inc., alleging the defendant failed to operate and maintain its Winter Park premises in a reasonably safe condition so as to be free of any unreasonable risk of harm.

According to the complaint, on Feb. 2, 2017, Scott Gifford was lawfully upon defendant's premises as an invitee when he fell violently on the concrete surface of a boat ramp, causing serious bodily injuries. 

Gifford said he had leaned against a swinging-hinged gate when the gate came loose from its hinges and pins causing him to fall downward striking his body. As a result of Scott Gifford's injuries, Julie Gifford says she has lost the services and companionship of her husband. 

The plaintiffs allege Country Lakes Community Association failed to properly and/or adequately inspect, maintain and repair the dangerously and/or defective gate, and/or gate hinges, and/or gate pins, which failed to reasonably secure the gate.

The Giffords seek trial by jury and damages in excess of $15,000. They are represented by attorney Mark P. Cressman of Winter Garden.
