Orlando homeowner alleges insurance company failed to cover property loss

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Michelle Gagnon filed a complaint Sept. 20 in Orange County Circuit Court against Florida Family Insurance Company, alleging failure to provide insurance coverage.

According to the complaint, between Aug. 28, 2013, and Aug. 28, 2014, during the policy period, Gagnon's dwelling at 5117 Turnbull Drive, Orlando sustained a covered loss due to water damage. 

Gagnon says she timely notified Florida Family of the damages and complied with all conditions precedent to entitle her to recover under the policy but the defendant has waived compliance by refusing to provide insurance coverage. 

The plaintiff alleges Florida Family Insurance has failed to provide coverage for Gagnon's losses.

Gagnon seeks trial by jury, damages of more than $15,000, with interest on any overdue payments, plus attorney fees and court costs. She is represented by attorney Bryan J. Festa of The Nation Law Firm LLP in Longwood.
