Motorist alleges Allstate failed to provide crash coverage

CLEARWATER — A Pasco County motorist is suing Allstate, alleging refusal to apply payments after a vehicle crash.

Lynn Day filed a complaint Sept. 21 in Pinellas Circuit Court against Allstate Fire and Casualty Insurance Company, alleging the insurance company failed to provide uninsured and under-insured motorist coverage.

According to the complaint, on Nov. 7, 2017, Lynn Day was driving near the intersection of Fivay Road and Little Road in Pasco County when she her car was hit by a 2013 Ford negligently driven by Terrance Jakovac, an uninsured or under-insured motorist. Day says she timely filed uninsured and under-insured motorist coverage. 

Although Day is not in possession of the copy of the policy, the suit says, she had a valid claim and has a full force and effect insurance policy and is liable for motorist coverage. 

The plaintiff alleges Allstate Fire and Casualty Insurance has refused to provide insurance coverage under uninsured or under-insured motorist coverage within the terms the policy and/or Florida law.

Day seeks trial by jury, damages of more than $15,000, plus costs, pre- and post-judgment interest and all other just relief. She is represented by attorneys Paul Puzzanghera and Christopher Hamblen of Puzzanghera Law Offices in Clearwater.
