Customer alleges Tarpon Springs automobile dealer refused to return vehicle

CLEARWATER — A New Port Richey vehicle owner is suing a Tarpon Springs automobile dealer, alleging wrongful possession. 

Timothy William Donohue filed a complaint Sept. 21 in Pinellas Circuit Court against Nasr's Auto Sales Inc., doing business as Exotic Motorcars and Marrissa Harrell, alleging they wrongfully took possession of the plaintiff's vehicle.

According to the complaint, in 2017, Donohue's 2007 Bentley was taken by defendants and they have refused to return the vehicle. Donohue says the property has not been taken for any tax, assessment or fine levied under any law of the Florida state, nor was it seized under any execution or attachment against and chattels of the plaintiff liable to execution. 

The plaintiff alleges Exotic Motorcars and Harrell wrongfully denied Donohue of his property by taking possession of the vehicle without compensation, and refusing to return possession to the plaintiff.

Donohue seeks trial by jury and judgment for possession. He is represented by attorney Jonathan P. Hempfling of Marcadis Singer PA in Tampa.
