Former patient alleges overcharging fees for medical records

CLEARWATER — A former medical patient has filed a class action lawsuit against a digital health company, alleging unjust enrichment.

Teresa Grimes, individually and on behalf of all those similarly situated, filed a complaint Sept. 20 in Pinellas County Circuit Court against Sharecare Health Data Services LLC, alleging violation of Florida's Deceptive and Unfair Trade Practices Act.

According to the complaint, Grimes was in an auto accident Jan. 15, 2017 that resulted in bodily injuries. The suit says after seeking medical treatment due to the accident, Grimes sought copies of her own medical records in order to pursue her legal rights. 

However, Grimes says, Sharecare Health Data refused to deliver the requested medical records until it received payment of charged fees that exceed the maximum amount allowable pursuant to Florida law. 

The plaintiff alleges Sharecare Health Data Services refused to produce copies of her medical records until after Grimes has paid the overcharged fees.

Grimes seeks trial by jury, declaratory and injunctive relief, damages of more than $15,000, plus prejudgment interest and all other fair and reasonable relief.
