Patron alleges Publix's negligence caused motorized shopping cart to tip over

CLEARWATER — A Pinellas County woman is suing Publix, alleging negligence led to injuries for the plaintiff from a tipped shopping cart. 

Marlaine Graham filed a complaint on Sept. 20, in the Pinellas Circuit Court against Publix Super Markets Inc. alleging that the supermarket operator breached its duty to exercise reasonable care for her safety while onsite their store.

According to the complaint, on June 5, 2017, Graham was a patron at Publix store No. 1320 in Seminole when the motorized shopping cart she was using tipped over. Graham says she sustained serious permanent and continuing injuries resulting in pain, suffering, mental anguish, lost wages and medical expenses. 

The plaintiff alleges Publix Super Markets failed to properly maintain their riding motorized shopping cart, failed to take reasonable measures and/or remedy the defective motorized shopping cart and failed to give adequate warning of the dangerous condition.

Graham seeks trial by jury, damages in excess of $15 000, with interest, court costs, attorney fees and all other just, proper and equitable relief. She is represented by attorney John D. Andreopoulos of Andreopoulos Law Firm in Holiday.
