Daughter blames Orlando property operators for father's death

ORLANDO — A daughter and members of her family are suing Orlando property operators, alleging negligence led to a man's death.

Dwaysha Stuart, as representative for the estate of Dwayne A. Stuart,  et al. filed a complaint Sept. 17 in Orange County Circuit Court against Chill Games Room LLC, doing business as Chill Games Room, McCormac-Maguire Kennedy Property LLC and Ruta Supermarket Inc., alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, on Sept. 17, 2016, Dwayne A. Stuart, was at Chili Games Room, 907 S. Goldwyn Ave., Orlando, as a patron. The suit says Stuart was shot and killed as he was walking toward the parking area, due to an altercation and violent shooting between other patrons of the bar. 

As a result, the lawsuit states, Stuart's survivors have lost his support, services and net accumulation, and further incurred expenses relating to medical, funeral and other expenses relating to his death. 

The plaintiffs allege the defendants failed to provide adequate security for the premises, failed to warn invitees utilizing the premises of the risk of injury from criminal acts and failed to evaluate and address criminal activity on their premises.

The Stuart family seeks trial by jury, damages in excess of $15,000 exclusive of attorney fees, court costs and interest. They are represented by attorney Bradley N. Laurent of The Law Offices of Haynes & Laurent PA in Orlando.
