Employee alleges he was fired after filling workers' compensation claim

ORLANDO — An Orange County man is suing a service industry cleaning company, alleging wrongful termination.

Eliseo Damas filed a complaint Sept. 17 in Orange County Circuit Court against Vistana Management Inc. alleging the defendant terminated the plaintiff for filling for workers' compensation benefits.

According to the complaint, on March 15, Damas sustained an industrial accident when he was bitten by a spider in the laundry room of a Sheraton Hotel in the course and scope of his employment for the defendant. 

Damas says he filed for workers' compensation benefits and returned to work after a short period of time and resumed normal work duties. The suit says he was stopped by two security guards who escorted him out of the building. He was later informed that he was terminated after filling for workers' compensation benefits, the suit says. 

The plaintiff alleges Vistana Management personally notified him that he was terminated because he had a lawsuit against the defendant based on the workers’ compensation claim.

Damas seeks trial by jury, actual, consequential and compensatory damages of more than $15,000, back pay, pre- and post-judgment interest, and all other just and appropriate relief. He is represented by attorneys Joseph Perea and James Loren of Goldberg & Loren PA in Plantation.
