ORLANDO — A property owner is suing an insurance company, citing alleged breach of contract.
Eric Alvaro filed a complaint on Sept. 17 in the 9th Judicial Circuit Court of Florida-Orange County against Security First Insurance Company alleging breach of insurance policy by denying plaintiff's claim and refusing to pay the full amount of damages sustained.
According to the complaint, on May 29, 2018, Eric Alvaro's property was damaged by a covered loss and he gave the defendant timely notice of the loss. Plaintiff also claims he performed all conditions precedent to obtain insurance benefits under his policy but defendant allegedly to refused provide insurance benefits despite assigning claim and inspecting the property.
The plaintiff holds Security First Insurance Company responsible because the defendant allegedly refused to pay any insurance benefits to plaintiff's claim and refused to pay the full amount of plaintiff's covered loss.
The plaintiff requests a trial by jury and seeks judgment for damages together with interest, costs and attorney's fees, and for such further relief the court deems just and proper. He is represented by Kimesha S. Smith of Insurance Litigation Group, PA in Miami.
