Vehicle passenger alleges insurance company owes her coverage

ORLANDO — A vehicle passenger from Orlando is suing an insurance company, alleging breach of a contract.

Jack Aper filed a complaint Sept. 17 in Orange County Circuit Court against Southern-Owners Insurance Company, alleging failure to provide uninsured/underinsured motorist coverage.

According to the complaint, on Aug. 9, 2017, Jack Aper was a passenger in a motor vehicle that was struck at state Road 436 in Casselberry, Seminole County by a car negligently operated by Hughey Colton Carter. 

Aper says he furnished timely notice to Southern-Owners of the automobile crash and proof of the claim for damages. The suit says Aper has performed all other conditions precedent to entitle recovery under the uninsured/underinsured portion of the Southern-Owners policy but has failed to receive any coverage. 

The plaintiff alleges Southern-Owners Insurance has denied the coverage that exists and has refused to pay Aper for the full value of the claim.

Aper seeks trial by jury,damages of more than $15,000 and all other proper relief. He is represented by attorney Joseph H. Shaughnessy of Morgan & Morgan PA in Orlando.
