Massachusetts couple alleges Disney World's negligence led to wife's injuries

ORLANDO — A Massachusetts couple is suing a Walt Disney resort, alleging negligence led to the wife falling and suffering injuries.

Eva Maciel and Luis Maciel filed a complaint Sept. 12 in Orange County Circuit Court against Walt Disney Parks & Resorts US, Inc., doing business as Walt Disney World, alleging failure to maintain and keep its premises in a reasonably safe condition.

According to the complaint, on Jan. 21, Eva Maciel stepped onto an elevated platform to pose for a photograph next to a stockade in the Liberty Square section of the Magic Kingdom Theme Park. The suit says Maciel was caused to fall due to the uneven and defective surface below the platform, causing injuries in and about her body, pain and suffering, disability, disfigurement, loss of wages and mental anguish. 

As a result, Luis Maciel says he continues to suffer the loss of his wife’s consortium, support, services and society. 

The plaintiffs allege Walt Disney World failed to repair an unreasonably dangerous defect of which it knew or should have known about, failed to close off or barricade an area containing an unreasonably dangerous defect and failed to warn of an unreasonably dangerous defect.

The Maciels seek trial by jury, damages of more than $15,000, post-judgment interest as allowed by law and court costs. They are represented by attorneys Thomas Scolaro and Justin B. Shapiro of Leesfield Scolaro, PA in Miami.
