CLEARWATER — A Pinellas County man is suing a county resident, alleging failure to warn in spreading a contagious disease.

John Doe filed a complaint Sept. 18 in Pinellas County Circuit Court against Marius Adrian Visoiu, alleging the defendant exposed his illness to members of the public, particularly to the plaintiff.

According to the complaint, John Doe has contracted a dangerous and highly contagious disease from Visoiu, causing the plaintiff to suffer permanent injuries, mental anguish and loss of capacity to enjoy life. John Doe alleges that despite the defendant having knowledge of his sickness, Doe was not warned about the contagious disease.

The plaintiff alleges Visoiu failed his duty, once diagnosed, to warn the public that he had been exposed to a dangerous and highly contagious disease so that he could timely seek medical intervention.

John Doe seeks trial by jury, damages of more than $15,000, plus court costs and interest on all liquidated damages. He is represented by attorney Mark H. Perenich of Perenich, Caulfield, Avril & Noyes PA in Clearwater.
