Orlando property owner alleges insurer refuses to comply with insurance contract

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Magalie Nerette filed a complaint Sept. 12 in Orange County Circuit Court against American Security Insurance Company, alleging the defendant has refused to honor its contractual obligations contained in the policy.

According to the complaint, on Sept. 8, 2017, Nerette's property at 4587 Frisco Circle, Orlando, sustained a covered loss as a result of water damage associated with Hurricane Irma. The suit says Nerette notified American Security about the loss. 

However, despite the defendant assigning a claim number and an adjuster to adjust the loss, Nerette says, the insurance company has refused to provide coverage despite being required to do so under the policy. 

The plaintiff alleges American Security Insurance has refused to pay all monies owed for a covered property loss as required by the contract.

Nerette seeks trial by jury, compensatory damages of more than $15,000, plus interest, court costs and reasonable attorney fees. She is represented by attorney Brenda Fetherhuff of Atilus and Associates PLLC in Fort Lauderdale.
