Publix supermarket sued by shopper claiming she slipped on wet floor

ORLANDO — A shopper is suing Publix Super Markets Inc., claiming she slipped on a spilled can of soda inside the store and injured herself in the fall.

Dianelys Izquierdo filed a complaint on Sept. 12, in the 9th Judicial Circuit Court of Florida - Orange County, against Publix Super Markets Inc,. alleging that the supermarket failed to provide proper training regarding the stacking of soda case on the shelves.

The plaintiff alleges that on Sept. 29, 2017, she was a customer at the Publix on 7653 S. Orange Blossom Trail when she slipped and fell on spilled soda on the floor. 

She claims she was injured and has suffered pain. She says in the complaint she incurred medical expenses for hospital treatment.

The plaintiff holds Publix Super Markets Inc. responsible because the defendant allegedly negligently allowed the condition to exist on its premises, failed to eliminate the danger or give warning of the hazardous condition.

The plaintiff requests a trial by jury and seeks damages of more than $15,000, exclusive of interest, costs and attorney's fees. She is represented by Axel J. Dumas of the Pendas Law Firm in Orlando.
