Orlando property owner alleges insurer failed to pay for hurricane damage

ORLANDO — An insured Orlando property owner is suing a licensed insurer, alleging breach of an insurance contract.

Elba Guevarra filed a complaint Sept. 12 in Orange County Circuit Court against Universal Property & Casualty Insurance Company, alleging failure to honor its obligations under the terms of the policy after a hurricane.

According to the complaint, on Sept. 10, 2017, Guevarra's insured’s property, 1330 Abbeyville Road, Orlando, sustained a covered loss as a result of water damage associated with Hurricane Irma. The suit says the Universal policy was in full force and effect. 

As a result of the defendant's conduct, Guevarra says she has suffered and continues to suffer substantial hardship. The plaintiff alleges Universal Property & Casualty Insurance, in spite acknowledging coverage for the loss, has denied Guevarra's claim and denied to make any payment.

Guevarra seeks trial by jury, compensatory and consequential damages of more than $15,000, plus interest, attorney fees, court costs and all other just and proper relief. She is represented by attorney Stephanie Feldman of Feldman & Lopez PA in Miami.
