Motorist alleges another driver's negligence caused crash on I- 275 exit ramp

CLEARWATER — A motorist is suing another driver, alleging negligence caused a crash that injured the plaintiff.

Bruce Mallory filed a complaint Sept. 7 in Pinellas County Circuit Court against Jose Gutierrez, alleging the defendant failed to operate a vehicle in a safe manner.

According to the complaint, on Feb. 9, Mallory was lawfully driving near the intersection of the Interstate Highway 275 exit ramp and 22nd Avenue North in Pinellas County when he was struck by Gutierrez's vehicle. 

Mallory says he he sustained bodily injuries, disability, disfigurement, mental anguish and the expense of hospitalization. 

The plaintiff alleges Gutierrez negligently operated or maintained his motor vehicle so that it collided with Mallory's car. 

Mallory seeks trial by jury, damages in excess of $15,000, plus court costs and interest. He is represented by attorney D. Keith Thomas of Yanchuck, Berman, Wadley, Thomas & Berman, PA in St. Petersburg.
