Walmart customer alleges negligence caused fall in parking lot

CLEARWATER — A Pinellas County woman is suing Walmart, alleging negligence caused her to fall in the store parking lot.

Luella Rogers filed a complaint Sept. 7 iPinellas County Circuit Court against Walmart Inc. and store manager John Doe, alleging failure to maintain the premises of the Clearwater store in a reasonably safe condition.

According to the complaint, on Nov. 21, 2017, Rogers was the Walmart store on Roosevelt Boulevard in Clearwater when she fell while in the parking lot. Rogers says she was unaware of the slippery and/or dangerous condition in the walkway of the parking lot surface areas where she fell and sustained injuries. 

The plaintiff alleges Walmart and John Doe failed to adequately inspect its premises, including its walkway and parking lot surface areas, and failed to adequately warn invitees of the dangers of an unlevel and/or slippery surfaces. 

Rogers seeks trial by jury, damages in excess of $15,000, plus interest, court costs and attorney fees. She is represented by attorney Steven A. Capriati of Morgan & Morgan Tampa PA in Tampa.
