Hotel guests blames negligence for hot tub injuries

CLEARWATER — A guest is suing St. Pete Beach hotel owners, alleging negligence caused him to suffer hot tub injuries.

Daniel M. Davis filed a complaint Sept. 6 in Pinellas Coutny Circuit Court against Host Hotels & Resorts LP, Don Cesar TRS LLC and Loews St. Pete GP LLC, alleging failure to maintain its premises in a safe condition.

According to the complaint, on Aug. 31, 2017, Davis was at the Don Cesar Hotel, 3400 Gulf Blvd., St. Pete Beach, as a guest. The suit says as Davis attempted to get into a hot tub, he failed to anticipate that the second step was further down. As he grabbed the hand safety rail for stability, Davis alleges, the rail gave way due to it being improperly secured/fastened.

The suit says Davis slipped, causing injuries in and about his body and extremities, pain, physical handicap, mental anguish and impairment. 

The plaintiff alleges Host Hotels & Resorts, Don Cesar TRS and Loews St. Pete failed to properly inspect and maintain the property, and failed to remedy defects on the property to prevent injuries to guests.

Davis seeks trial by jury, damages of more than $15,000, interest, costs and all other just and proper relief. He is represented by attorney Patrick W. Harland Jr. of The Law Firm of Patrick W. Harland Jr. LLC in St. Petersburg.
