Musician alleges promoter's negligence caused fall into orchestra pit

CLEARWATER — A Sarasota County band member is suing a promoter and the city of Largo, alleging negligence caused his fall into an orchestra pit.

Todd Pitts filed a complaint Sept. 7 in Pinellas County Circuit Court against Allengang Entertainment LLC and the city of Largo, alleging the promoter and property operator failed to follow applicable safety guidelines and regulations.

According to the complaint, on Feb. 3, Pitts was at Central Park Performing Arts Center, 108 Central Park Drive, Largo, to perform with his band for a concert promoted by Allengang. The suit says, during a sound check, Pitts fell into the uncovered orchestra pit.

Pitts says he sustained injuries, pain and suffering, disability, physical impairment and disfigurement, mental anguish, inconvenience, loss of enjoyment of life, medical expenses and/or the aggravation of a pre-existing injury. 

The plaintiff alleges Allengang Entertainment and Largo failed to adequately inspect and maintain the premises, ingress, egress, stage, orchestra pit cover area and failed to warn Pitts and others of the dangerous condition on the property.

Pitts seeks trial by jury, general damages in excess of $15,000, plus costs, interest, and all other proper relief. He is represented by attorneys Mark H. Wright and Christopher P. Jayson of Jayson, Farthing, Skafidas & Wright PA in Tampa.
