Customer alleges bank's negligence caused tripping hazard at ATM drive

CLEARWATER — A customer is suing bank owners, alleging negligence caused her injuries.

Stephanie Stovall filed a complaint Sept. 6 in Pinellas County Circuit Court against Suntrust Banks Inc. and Clearwater Beach BNK Investors DBT, alleging failure to maintain the premises in a reasonably safe condition.

According to the complaint, on Nov. 7, 2015, Stovall was lawfully on the defendants' premises, 423 Mandalay Ave., Clearwater, when she tripped and fell over a protruding and exposed electrical junction box on the curb in the ATM drive. 

As a result, Stoval says she sustained boldly injury, loss of the capacity for the enjoyment of life and the expense of hospitalization. 

The plaintiff alleges Suntrust Banks and Clearwater Beach BNK Investors failed to correct or repair any unsafe or dangerous condition(s) of which they were aware or should have been aware through the exercise of reasonable care.

Stovall seeks trial by jury damages in excess of $15,000, plus prejudgment interest and costs. She is represented by attorney Marcus W. Viles of Viles & Beckman LLC in Fort Myers.
