ORLANDO — A customer is suing Wal-Mart, alleging negligence caused her to fall on the floor.
Edim de la Cruz filed a complaint Sept. 6 in Orange County Circuit Court against Wal-Mart Stores East LP, alleging failure to exercise reasonable care to maintain the premises in a reasonably safe condition.
According to the complaint, on July 29, 2015, de la Cruz was legally at the Wal-Mart premises in Orange County, pushing her shopping cart, when she slipped and fell on a liquid substance on the floor of an aisle.
As a result, de la Cruz says she sustained bodily injury, scarring, disfigurement, past and future medical expenses.
The plaintiff alleges Wal-Mart Stores East failed to reasonably correct or repair the dangerous conditions/concealed peril it knew about or should have known about, thus permitting an unsafe condition to remain on the floor.
De la Cruz seeks trial by jury, compensatory damages in excess of $15,000, exclusive of interest and court costs. She is represented by attorneys Christina Arguelles, and Carlos R. Diez-Arguelles of Diez-Arguelles & Tejedor PA in Orlando.
