Orlando property owners allege insurer breached contract

ORLANDO — Two Orlando property owners are suing a licensed insurer, alleging breach of an insurance contract.

Carl Peterson and Amy Peterson filed a complaint Sept. 6 in Orange County Circuit Court against Tower Hill Select Insurance Company, alleging failure to perform under the terms of the policy.

According to the complaint, on Dec. 1, 2017, the Petersons' property at 428 Oak Lynn Drive, Orlando, sustained damage as a result of a water loss. The suit says this occurred during the policy period provided by Tower Hill. 

The Petersons allege they have complied with all conditions precedent to entitle them to recover under the policy. but Tower Hill Select Insurance has failed to fully value the plaintiffs’ damages and failed to fully pay for all of their losses as required by the insurance policy.

The Petersons seek trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. They are represented by attorney Hans Kennon of Morgan & Morgan PA in Orlando.
