Visitor alleges Walt Disney resort refuses to show surveillance video of scooter collision

CLEARWATER — A Louisiana tourist is suing a Walt Disney resort, alleging insufficient breach of duty and concealment.

Shirley Aydell filed a complaint Sept. 6 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S. Inc., alleging the defendant refused to assist her in providing information about an individual who struck her with a scooter.

According to the complaint, on May 16, 2016, Aydell was a business invitee at Walt Disney World Resort in Orlando. The suit says Aydell was shopping at the park when she was struck by a motorized scooter driven by another Disney guest. The lawsuit states Aydell suffered a broken ankle that required surgery,

Aydell said she was advised by Disney that it would be able to identify the scooter driver because it had footage of the incident. However, the plaintiff says, she was not provided with any surveillance video. 

The plaintiff alleges Walt Disney Parks and Resorts has refused to release the surveillance video or to provide Aydell with the name and contact information for the person who struck her.

Aydell seeks trial by jury, a copy of the surveillance video taken of the incident, disclosure of the identity of the person who struck her and all other just and proper relief.
