Passenger alleges negligence from vehicle's driver and owner caused crash

ORLANDO — An Orange County man is suing a vehicle driver and owner, alleging negligence. 

Derrick Herron filed a complaint Aug. 30 in Orange County Circuit Court against Charles R. James and Werner Enterprises Inc., alleging a vehicle driver and owner failed to exercise reasonable care in operating a motor vehicle.

According to the complaint, on Nov. 17, 2014, Herron was a passenger in a car traveling southbound on U.S. Highway 41 near West Hampshire Street. The suit says Herron was injured when his vehicle was struck by the vehicle driven by James and owned by Werner Enterprises. 

Herron says he suffered injuries resulting in medical expenses, pain and suffering, disfigurement, mental anguish and loss of earnings. The plaintiff alleges James failed to yield right of way and improperly attempted to make a U-turn when its was not safe to do so.

Herron seeks. trial by jury, damages and all other just relief. He is represented by attorney Kurt K. Thompson of Kurt Thompson Law Group in Boca Raton.
