Insurance company denied sinkhole claim, resident says

ORLANDO — A homeowner accuses an insurance company of wrongfully denying a property damage claim.

Emma I. Peacock filed a complaint on Aug. 30 in the 9th Judicial Circuit Court of Florida against Universal Property & Casualty Insurance Company, alleging that the liability insurer failed to perform under the terms of the policy.

According to the complaint, the plaintiff's property was damaged as a result of a sinkhole. Subsequently, she made a claim for the benefits due under the policy provided by the defendant. The plaintiff claims the company failed and refused to pay the covered losses.

The plaintiff requests a trial by jury and seeks all damages to which she is entitled. She is represented by Ryan S. Burke and Wesley Dicus, Sr. of Dicus & Burk PLLC in St. Petersburg and Robert L. Nipps of Robert L. Nipps PA in Tampa.
