Largo property owners allege insurance company failed to cover water damage

CLEARWATER — Two Largo property owners are suing an insurance company, alleging breach of contract.

Damian Zajac and Brittany C. Zajac filed a complaint Aug. 24 in Pinellas County Circuit Court against Florida Peninsula Insurance Company, alleging failure to pay for all the plaintiffs' losses.

According to the complaint, between April 14, 2016 and April 14, 2017, during the policy period, the plaintiffs' dwelling at 13471 Croft Drive, Largo, sustained a covered loss due to water damage. 

The Zajacs say they notified Florida Peninsula of the damages and received an assigned date of loss. However, the suit says, they have failed to receive coverage in order to recover under the policy. 

The plaintiffs allege Florida Peninsula Insurance has failed to provide coverage for certain of the plaintiffs' losses and failed to pay for all the plaintiffs' losses.

The Zajacs seek trial by jury, damages of more than $15,000, interest on any overdue payments, any incidental and foreseeable consequential damages, plus attorney fees and court costs. They are represented by attorney Logan Templeton of The Nation Law Firm LLP in Longwood.
