Couple alleges Dunedin VFW hall negligence led to both falling

CLEARWATER — A couple is suing a Dunedin VWF facility, alleging negligence led to both of them falling at a side entrance.

Joseph L. Richard and Gloria R. Richard filed a complaint Aug. 24 in Pinellas County Circuit Court against SPC Zachary L. Shannon Memorial Post 2250 Inc., also known as VFW Dunedin Palm Harbor 2550 Inc., alleging failure to provide a safe environment to the public.

According to the complaint, on Oct. 29, 2017, the Richards were walking out of the side entrance of the VFW hall in Dunedin when Gloria Richard suddenly tripped over a dangerous curb, which also caused Joseph Richard to fall. 

The suit says both plaintiffs proceeded to fall to the ground in awkward position, causing injuries, pain and suffering, disability, disfigurement and loss of the capacity to enjoy life. 

The plaintiffs allege VFW Dunedin Palm Harbor 2550 failed to properly maintain the entrance of the premises, including issues with lighting and close walking to the parking lot.

The Richards seek trial by jury, damages that exceed $15,000, court costs, interest, and all other just and proper relief. They are represented by attorney Jeffrey P. Diamond of Burnetti PA in Tampa.
