Orlando property owner alleges State Farm failed to cover hurricane damage

ORLANDO — An Orlando property owner is suing State Farm, alleging breach of an insurance contract.

Eduardo Lima filed a complaint Aug. 23 in Orange County Circuit Court against State Farm Fire and Casualty Company, alleging failure to comply with the agreed policy contract to cover hurricane damage.

According to the complaint, on Sept. 10, 2017, Lima's property at 5403 Moonglow Blvd., Orlando, was damaged by Hurricane Irma, and he gave timely notice to State Farm of the loss. 

Despite Lima providing State Farm a full and particular account of his expenses and losses and complying with all conditions precedent to bringing the instant cause, the suit says, he has been denied coverage. 

The plaintiff alleges State Farm Fire and Casualty failed to establish it had reasonable proof that it was not responsible for the payment of Lima's damages and/or loss, and has failed to pay the requested amounts for repairs and/or replacement.

Lima seeks trial by jury, damages in excess of $15,000, plus interest, attorney fees, court costs, and all other just and proper relief. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group, PA in Coral Gables.
