ORLANDO — Chili's Bar & Grill is being sued after a patron claims he tripped on the sidewalk and injured himself outside the restaurant in Orlando.

Gordon and Tracey Melbourne-Skeech filed a complaint on Aug. 23, in the 9th Orange County Judicial Circuit Court, against Brinker Florida Inc,. doing business as Chili's Bar & Grill, alleging that the restaurant failed to keep the sidewalk safe for pedestrians.

The couple alleges that on Aug. 24, 2016, Gordon suffered bodily injury, disability, mental anguish, loss of the capacity for the enjoyment of life, medical expenses, loss of earnings, loss of the ability to earn money, and aggravation of pre-existing conditions, after falling outside the restaurant.

The couple is claiming negligence. They allege that the sidewalk was in a "defective condition" directly in front of the Chili's branch at 7021 International Drive in Orlando, Florida. Additionally, his wife has lost his care, comfort, society and consortium.

The plaintiffs hold Brinker Florida Inc., doing business as Chili's Bar & Grill, responsible because the defendant allegedly failed to correct a known dangerous condition, and failed to warn patrons of the dangerous condition.

The plaintiffs request a trial by jury and seek judgment against defendant for damages which exceeds $15,000.

They are represented by Barry S. Friedman of The Friedman Law Firm PA in Boca Raton and Arthur Hernandez of Law Offices of Arthur Hernandez PA in Jacksonville.
