CLEARWATER — A Colorado husband and wife are suing a Florida boat company, alleging fraud.
Gary and Brenda Yates of Aurora, Colorado, filed a complaint Aug. 22 in Pinellas County Circuit Court against We Buy Boats LLC ,alleging the defendant obtained profit through distribution of a substandard product.
According to the complaint, on April 15, the Yateses won a bid to purchase a boat on Ebay for $38,387. The suit says the plaintiffs have suffered monetary loss because the boat does not have the value they anticipated. The lawsuit alleges the boat has several mechanical problems that the plaintiffs discovered after the purchase of the boat.
The plaintiffs allege We Buy Boats advertised the boat to be in great condition, and have refused to accept the boat back or pay for repairs. The suit says the couple already has expended $2,000 in legal fees and $455 in court costs.
Gary and Brenda Yates, seek trial by jury, damages of more than $15,000, plus attorney fees and court costs. They are represented by attorney Samuel P. Bennett of SBP Law PA in Punta Gorda.
