CLEARWATER — A fitness club customer is suing a St. Petersburg training facility, alleging failure to warn and negligence.

Brian Creadon filed a complaint Aug. 22 in Pinellas Circuit Court against Kuiken Enterprise LLC, doing business as Planet Fitness, alleging failure to provide a safe environment for its patrons.

According to the complaint, on Aug. 1, Creadon was working out at Planet Fitness, 66th Street North, St, Petersburg, when the TRX band he was using suddenly snapped, causing him to fall hard and directly on his back.

The suit says Creadon sustained bodily injury and resulting pain and suffering, mental anguish, loss of capacity for the enjoyment of life and expenses for medical nursing care and treatment.

The plaintiff alleges Planet Fitness failed to ensure that the equipment provided to its patrons was safe to use, as well as fully and properly operational.

Creadon seeks trial by jury, damages of more than $15,000, exclusive of interest, and court costs. He is represented by attorney George C. Andriotis of Andriotis Law Firm PA in Tarpon Springs.
