Visitor alleges St. Petersburg apartment complex owner's negligence caused stairway fall

CLEARWATER — A visitor is suing a St. Petersburg  apartment complex owner, alleging negligence led to a stairway fall.

Robert Eugene Smith filed a complaint on Aug. 22, in the Pinellas Circuit Court against Avesta Homes LLC, doing business as Avesta Madeira Grove alleging that the apartment complex owner breached its duty to maintain the stairway reasonably safe for its invitees.

According to the complaint, on May 22, 2017, Smith he was at Avesta Madeira Grove, 5870 56th Ave. N., St. Petersburg, when he slipped and fell on the stairway. Smith says he sustained bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity to enjoy life and loss of the ability to earn money. 

The plaintiff alleges Avesta Madeira Grove negligently maintained the stairway in a defective and.dangerous condition for a sufficient length of time and failed to give adequate warning of the existence of such a condition.

Smith seeks trial by jury, damages of more than $15,000, plus costs. He is represented by attorney Austin J. Grinder of The Ruth Law Team in St. Petersburg.
