Orlando property owners allege insurer failed to cover weather damages

ORLANDO — Two Orlando property owners are suing a licensed insurer, alleging breach of an insurance contract.

Jose Herrera and Maritza Herrera filed a complaint Aug. 20 in Orange County Circuit Court against Southern Fidelity Insurance Company, alleging failure to perform its contractual obligations relating to weather damages.

According to the complaint, on Aug. 1, 2017, the Herrera property, 10005 Richardson Court, Orlando, was damaged by a weather during the policy period.

The Herreras said they gave timely notice of the claim to Southern Fidelity for the loss but have been unsuccessful in receiving payments. 

The plaintiffs allege Southern Fidelity Insurance failed to pay the requested amounts for repairs, replacement and other remedial measures.

The Herreras seek trial by jury, damages of more than $15,000, exclusive of interest, court costs, attorney fees and all other just and proper relief. They are represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
